* In the Douglas County Court there is case #1989S0268 filed on November 15, 1989 and captioned Ivory Dewitt and Dewitt Excavating v. James Cavanaugh and Rampart Drilling. That case was described as a small claims money matter dispute.

* In the Douglas County Court there is case #1989M0477 filed on July 26, 1989 and captioned People of the State of Colorado v. James F. Cavanaugh. That misdemeanor criminal case charged Cavanaugh with one count 3rd Degree Assault. The count was dismissed by the Court.

Review of civil, criminal and bankruptcy cases filed during the past twenty years with the United States District Court for the District of Colorado found three cases involving James Frances Cavanaugh.

* In the United States District Court for bankruptcy for the District of Colorado there is case #89-16883-MER filed on December 15, 1989 and captioned The Bankruptcy Estate of James Frances Cavanaugh. That Chapter 7 bankruptcy filing remained active until March 16, 2004. Cavanaugh was represented by attorney Melissa McCue. The case is currently archived at the Federal Records Center and review of that case may find the State Court, civil litigation and judgments previously described in this report may have been included in that bankruptcy petition.

* In the Criminal Division of the United States District Court for the District of Colorado there is case #1993MJ01779 captioned United States of America v. James Frances Cavanaugh. In that case Cavanaugh was charged on December 22, 1993 with one count bankruptcy fraud. Cavanaugh was described as a fugitive from justice as he had fled the United States.

* A second criminal case was filed under case #94CR00219LTB on August 9, 1994 and charged Cavanaugh with one count conspiracy to commit fraud, one count bank fraud, one count bankruptcy fraud and a second count of bankruptcy fraud. In that case Cavanaugh was represented as an indigent defendant by the Office of the Federal Public Defender and specifically attorney Virginia L. Grady. Cavanaugh entered a guilty plea to one count bankruptcy fraud in exchange for a dismissal of the three other counts. Cavanaugh was admitted to the United States Bureau of Prisons, inmate registration #83907-079, upon his arrival in Colorado pursuant to a fugitive warrant. Cavanaugh was discharged from United States Bureau of Prisons on or about December 20, 1999.

Further research performed of the criminal case involving Cavanaugh found Cavanaugh was indicted on August 9, 1994 and charged with felony counts of Conspiracy to Commit Fraud, Bank Fraud and Bankruptcy Fraud. Cavanaugh was not in the United States when he was indicted and fugitive warrant was issued for his arrest. At some later point Cavanaugh attempted to enter the United States and was arrested by Customs officials upon entry into the United States for the outstanding fugitive warrant. Cavanaugh was transferred to the Federal Department of Corrections facility in Englewood , Colorado and remained at that facility until he was arraigned. Because Cavanaugh was viewed as a flight risk bond was denied and Cavanaugh was remanded to the FDC facility in Englewood, Colorado where he remained until a plea bargain was negotiated between the Office of the Federal Public Defender and the United States attorney for the District of Colorado. Cavanaugh negotiated a plea agreement in which he pled guilty to one count Bankruptcy Fraud, a class 6 felony, in exchange for a dismissal of the remaining counts. Judge Lewis T. Babcock sentenced Cavanaugh to imprisonment for the time served in the FDC facility and Cavanaugh was released.

There were reportedly additional violations of bankruptcy law and bank law as a result of Cavanaugh’s earlier bankruptcy filing. The suggestion that Cavanaugh was in violation of bankruptcy code solely as a result of his sale of livestock apparently does not appear to provide a full explanation of the bankruptcy and bank fraud charges.
